Neighbors don't welcome low-income apartments Kennedy Heights residents say developer misled them BY ALLEN HOWARD The Cincinnati Enquirer It is no accident that Kennedy Heights has become a model community. When blacks began to move to the area almost half a century ago, they formed an alliance with whites to work toward a balanced neighborhood. It worked. Although the racial makeup is 70 black to 30 white, the community is filled with single-family houses, clean streets and residents who mix through social and religious activities. But many say the harmony is being threatened by a proposed apartment complex nearby in Columbia Township for low-income tenants both white and black. 'We have worked hard to develop and maintain a balanced community,' said Paul Hoeting of Glen Edge Drive, less than a block from the proposed rental apartments. 'The issue with us is not low-income tenants, but we don't know what kind of impact it will have in this neighborhood that is pretty much saturated already.' A block away, Margaret Peyton of Edgeview Drive is concerned whether the apartments will enhance the neighborhood or create more problems. 'We are trying to maintain a viable community, and I don't like the idea of a developer telling us he is going to build the units whether we like it or not without any concern of preserving the community at its present status,' Peyton said. Peyton fears that low-income tenants might not have the same concern with keeping a viable community as howeowners have. Reginald Van Acklin is accused of forcing two women in separate incidents last week to perform oral sex on him and threatened to shoot them if they did not, court records show. Acklin, 29, of the 3000 block of Mathers Street, pleaded not guilty to rape and rape with the threat of force Saturday in Municipal Court. Judge Michael Allen set bond at $100,000. He was arrested Friday after police responded to a call of a possible rape in progress in the 3000 block of Melish Avenue. Police say they found him and a 36-year-old woman naked from the waist down, court records show. In the first incident Nov. 13, he is accused of holding a gun to a 23-year-old woman's head and forcing her to perform oral sex, then beat-' ing her, court records showed. The Cincinnati EnqulrerJeny Dowling The issue has escalated into a petition drive by residents of Kennedy Heights who have been joined by residents from Madisonville, Pleasant Ridge, Evanston and Columbia Township to try to stop the project. The dispute started a year ago when developer William Brisben, president of the Brisben Cos. in Blue Ash and Price Hill, changed his plans from building condominiums to rental apartments. According to Kennedy Heights residents Brisben never told them Eagle's View Condominiums suddenly were becoming Eagle's View Apartments. The original plans, which had the approval of the Kennedy Heights Community Council, called for 13 buildings with 18 units each that would sell from $80,000 to $100,000 each. Each was to be 1,400 to 1,600 square feet. The new plans call for the units to be 1,150 square feet. And they are not for sale. The amenities have changed, too. The original plans called for grassy areas, a clubhouse, a guard house, a swimming pool and a tennis court. Now the amenities include just just hanging around in their drawers,' said Leanne Wiseman, LensCrafters' mission director for the project. 'They cost $150, and you don't want to throw them out. Tax map office moves BAT A VIA By Monday, the Clermont County engineer's tax map office will be moved up and across Main Street from its old courthouse quarters. The office keeps tax and survey records and sells them for public use. Temporary quarters are in the front section on the first floor of the old post office at Fourth and Main streets. Incinerator gets OK EAST LIVERPOOL, Ohio A federal appeals court has cleared the way for a hazardous-waste incinerator to continue limited operations until it obtains final commercial use permits. The 6th U.S. Circuit Court of Appeals in Cincinnati on Friday reversed a ruling by a lower court that required Waste Technologies Industries to shut down after a trial burn last spring. The appeals court said U.S. District Judge Ann Aldrich in Cleveland did not have jurisdiction. Russell Sparks, Hamilton County zoning administrator, said he didn't think the project could be stopped. He explained that under the Ohio Condominium Act, there is no distinction between apartment units and condominiums. State to study process for seeking bids The Associated Press COLUMBUS, Ohio The attorney general's office will review the state's process of seeking construction managers for state-funded projects, the Columbus Dispatch reported Saturday. The newspaper said the Department of Administrative Services' division of public works apparently violated notification laws for some projects, including the new building for the Center of Science and Industry (COSI) in Columbus. 'We intend to have a discussion with the client on some of these issues,' said Dan Malkoff, an assistant attorney general in the business and government regulations section. Ohio law says the state must advertise in a newspaper its intent to employ construction managers, and the ad must be published at least 30 days before the date proposals are to be accepted. The newspaper said an ad for a $67 million building for the College of Business at Ohio State University had a deadline of 16 days. A revised ad had a deadline of 29 days. In other cases, including the COSI project, there were no newspaper ads. The General Assembly had appropriated $18 million to help COSI relocate to a new building estimated at $110 million.
